Draft for legal review. This text was prepared to be reviewed by a lawyer qualified in French law before Aura takes its first paying member. Anything in [square brackets] still has to be filled in or confirmed. A French-language version should be the binding one for members resident in France.
Aura Social Club is operated by [legal name of the company or association], [legal form, e.g. SAS or association loi 1901], registered at [full address, Lille], registration number [SIREN / RNA], VAT number [if registered]. You can reach us at hello@aura.club. Publication manager: [name].
These terms form the contract between you and us when you become a member. Please read section 9 carefully: it explains what we are and are not responsible for.
Membership is open to women aged 18 or over. You join by completing the form on our site, agreeing to these terms, and setting up payment.
Membership is personal to you. You may not lend it, share it or transfer it to anyone else. You may bring a guest to events that are marked as open to guests, and you remain responsible for your guest while they are there.
We may decline an application or close a waiting list. If we decline your application we will not charge you, and we will delete the details you gave us in line with our privacy notice.
Membership does not include travel, accommodation, equipment you choose to buy, food and drink beyond what an event description states, or anything you agree separately with a third-party provider.
Membership costs €20 per month, including VAT where applicable. While the club is new we are charging an early-bird price of €15 per month, and we will give you at least one month's notice before that ends for you. This is the only recurring charge, and it does not include the cost of any activity.
Payment is taken monthly by card through Stripe, our payment provider. Your card details are given directly to Stripe and are never seen or stored by Aura. The first payment is taken when you join, and each following payment on the same day of the month.
If a payment fails we will retry it and let you know. If it is still unpaid after [number] days we may suspend your ability to book until it is settled.
We may change the price of membership. If we do, we will give you at least one month's notice by email before it applies to you, and you may cancel before the new price takes effect.
The members-only events described in section 3 are free to attend, though you pay for your own food and drink. Every other activity is priced per place and paid for when you book, currently between €30 and €75 depending on what it costs us to run. The price is always shown before you book, and it is the same for a member and a guest.
Seats are limited and go in the order they are taken. Members can see and book each month of the diary [7] days before guest places open; that is a head start, not a guaranteed place. Members also get an extra day to change their mind, as set out below.
This is separate from your membership. Ending your membership is free and possible at any time (section 8); the deadlines above apply only to a seat you have already paid for.
Repeatedly booking and not turning up takes a seat from someone else. If it becomes a pattern we may limit how far ahead you can book, after telling you first.
Because you join online, you have 14 days from the day you join to withdraw, without giving a reason (droit de rétractation, articles L221-18 and following of the French Consumer Code).
To withdraw, email hello@aura.club or use the standard withdrawal form. We will refund you within 14 days of being told, using the same means of payment.
When you joined you asked us to start your membership straight away. That is what lets you book in your first two weeks, and it means that if you then withdraw we may keep an amount in proportion to what you have already used, rather than refunding the whole month. Activities you have already booked and attended are paid for separately and are dealt with under section 6, not here.
If you would rather keep the full 14 days without using anything, email us before paying and we will hold your place instead.
You can cancel your membership at any time, with no notice period and no fee, from the "Your membership" section of your profile on this site. It takes effect immediately: nothing further is charged, and you keep access until the end of the month you have already paid for. You can undo it from the same place at any point before then. We do not refund part of a month. If you would rather tell us, hello@aura.club works too.
We may end your membership by giving you one month's notice, and refund any part of a month you have paid for but cannot use. We may end it immediately in the situations described in section 10.
This is the section people skim, so it is written plainly.
Aura organises gatherings and introduces you to activities: pilates, tennis, padel, running, cold water, dinners and so on. You decide which of them to join. Some carry an ordinary risk of injury, and by booking you accept that ordinary risk.
Sessions are usually delivered by independent studios, clubs, instructors, restaurants and guides. They choose how the session is run, they are responsible for their own equipment, premises, qualifications and safety, and they carry their own professional insurance. Aura's role is to arrange the session and hold the seat for you. Where a session is run by a third party, your claim about how that activity was delivered is against them, and we will give you their details and help you make contact.
We do not ask you to send us medical information and we do not keep any. Tell the person running the session instead: they are the one who can act on it.
You are asked to hold personal liability cover (responsabilité civile), which is normally included in home insurance, for damage you might cause to someone else or to premises. Personal accident cover (garantie individuelle accident) is your choice and we recommend it for the sporting sessions. Aura holds [organiser's public liability insurance: insurer, policy number, territory covered].
We are responsible for organising what we say we will organise, with reasonable care. We do not exclude or limit our liability for death or personal injury caused by our own fault or negligence, for fraud, or for anything else that cannot be excluded under French law. Any clause claiming otherwise would not be valid, so we are not going to write one.
What we are not responsible for: your personal belongings, anything you agree directly with a third-party provider, or losses that were not a foreseeable consequence of something we did wrong.
We may cancel or change an event for reasons beyond our control, including weather, a venue withdrawing, illness or a provider cancelling. You are refunded in full for that place. We are not liable for costs you incurred separately, such as travel, so please do not book flights around a club dinner.
Membership depends on the room feeling safe. Our member code forms part of these terms.
We may suspend or end your membership immediately, without refund of the current month, if you harass, threaten or discriminate against another member, guest or provider; share another member's private information or photograph without their agreement; behave in a way that puts anyone's safety at risk; or damage a venue. Where it is proportionate we will speak to you first.
We may update these terms. For anything that materially affects you, we will give at least one month's notice by email, and you may cancel before it takes effect. Each version is dated, and the version you agreed to when you joined is recorded with your consent.
Tell us first: hello@aura.club. We aim to reply within [number] working days.
If we cannot resolve it, you may refer the matter free of charge to a consumer mediator: [name, address and website of the médiateur de la consommation Aura has signed up to]. You may also use the European online dispute resolution platform.
These terms are governed by French law. Nothing here removes the rights you have as a consumer, including the legal guarantee of conformity, and you may bring proceedings in the courts of your place of residence.
